1. Eligibility

To use myStory, you must:

1. Be at least 13 years old. If you are under 18, you must have parental consent to use the App.
2. Have the legal capacity to enter into a binding agreement.
3. Comply with these Terms and all applicable laws.

 

2. Account Registration and Security

1. Registration: To use myStory, you must register and log in using your Google or Apple account. We collect only your email address during this process.
2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at hello@mystory.lol if you suspect unauthorized use of your account.
3. Accuracy: You agree to provide accurate and complete information during registration and to update it as necessary.

 

3. Use of the App

1. License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
2. Content Ownership: You retain ownership of the stories you create (“User Content”). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, store, process, and display your User Content solely to provide and improve the App’s services.

5. Attempt to reverse-engineer, decompile, or hack the App.
6. Upload or generate content that is offensive, defamatory, or infringes on the rights of others.

4. Payments

1. Payment Processing: We use Stripe, Apple and Google, third-party payment processors, to handle payments for any premium features or subscriptions within the App. You agree to Stripe’s, Apple’s and Google’s terms and conditions when making a payment.
2. Fees: Any fees for premium features will be clearly displayed in the App. All fees are non-refundable unless otherwise required by law.
3. Billing Information: Stripe will collect and process your payment information. We do not store or have access to your payment details.

 

5. Intellectual Property

1. Our Content: The App, including its design, code, AI technology, and any content we provide (excluding User Content), is owned by Digital Atlas Limited and protected by copyright, trademark, and other intellectual property laws.
2. Feedback: If you provide feedback, suggestions, or ideas about the App, you grant us a perpetual, royalty-free right to use and incorporate them without any obligation to you.

 

6. Termination

1. By You: You may stop using the App and delete your account at any time.
2. By Us: We may suspend or terminate your access to the App at our discretion, with or without notice, if you violate these Terms or for any other reason we deem necessary.
3. Effect of Termination: Upon termination, your license to use the App ends, and we may delete your User Content.

 

7. Disclaimers and Limitation of Liability

1. As-Is Basis: The App is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
2. No Guarantee: We do not guarantee that the App will always be available, uninterrupted, or error-free, or that the stories generated will meet your expectations.
3. Limitation of Liability: To the fullest extent permitted by law, Digital Atlas Limited, its affiliates, and their respective directors, employees, or agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability to you will not exceed the amount you paid to us in the past 12 months.

 

8. Indemnification

You agree to indemnify and hold Digital Atlas Limited harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your User Content, or your violation of these Terms.

 

9. Governing Law and Dispute Resolution

1. Governing Law: These Terms are governed by the laws of England and Wales.
2. Dispute Resolution: Any disputes arising from these Terms or your use of the App will be resolved through negotiation. If negotiation fails, disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

 

10. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will notify you through the App or via email. Your continued use of the App after the changes take effect constitutes your acceptance of the updated Terms.
